Annexation
An Annexation Application is to request that property be annexed into the Town's corporate limits. Annexation is the process by which the Town extends its municipal services, laws, taxing authority and voting privileges to a new area. Annexations are considered by the Board of Commissioners (BOC) only when requested by the property owner. As part of the annexation, the Town must adopt a Plan of Services and a zoning designation for the subject property effective upon annexation. An application for a rezoning shall be submitted along with the annexation application.
The process outlined below is for annexation requests other than those that require a referendum per State law(properties outside the Urban Growth Boundary (UGB))
Step 1: Preliminary Meeting with the Planning Department
A preliminary meeting with Staff must take place prior to submittal of an application. To schedule a meeting, contact the Planning Department at (615)776-6704.
Step 2: Annexation Application Submittal
Annexation applications shall by submitted prior to the work session deadline as shown on the Board of Commissioners meeting schedule. Town Staff will review the request and create a detailed report to present to the BOC.
Step 3: Board of Commissioners Work Session - Initial Consideration
The BOC discusses whether they would like to consider annexing the requested property and whether the applicant should proceed with the annexation process.
Step 4: Board of Commissioners Regular Meeting - Referral to Planning Commission
The BOC will consider a resolution to annex the subject property and to consider a plan of services to be referred to the Planning Commission for a review and recommendation.
Step 5: Planning Commission - Annexation and Plan of Services Review and Recomendation
The Planning Commission will review the plan of services and annexation resolutions and provide a recommendation to the Board of Commissioners. Applicants should be prepared to present to the Commission showing where the property is located, why it is in the best interest of the Town to annex the property, and if the property owner intends to develop the subject property an illustrative concept plan of the development. The Planning Commission will provide a recommendation on annexation and the plan of services to the BOC. The Planning Commission will also provide a recommendation on the Zoning Classification for the territory proposed for annexation.
Step 6: Board of Commissioners
The annexation and Plan of Services Resolution along with the Ordinance to Amend the Zoning Map will be presented to the Board of Commissioners. The resolution for the annexation and plan of services will not be acted upon until the second and final reading of the Ordinance. The Ordinance to amend the zoning map will be considered for first reading by the BOC. The BOC will also establish a date for the required public hearing for the annexation, plan of services, and the Ordinance to Amend the Zoning Map.
Step 7: Board of Commissioners - Public Hearing
The Board of Commissioners shall conduct properly noticed public hearings for the annexation and plan of services and the Ordinance to Amend the Zoning Map. At a subsequent meeting of the BOC, the Board will consider approval of the resolution for Annexation and plan of services and the Ordinance to Amend the Zoning Map.
Step 8: Board of Commissioners - Final Action
The Board of Commissioners will consider approval of the resolution for annexation and the plan of services. Only one reading of the resolution is required and the resolution will become effective upon the date set in the resolution. The Board will also consider approval of the Ordinance to Amend the Zoning Map on second and final reading.
